Preamble

These Terms of Service ("Terms") govern your access to and use of ET.Verdict's digital legal research platform, AI-powered search engine, and related services ("Services"). By accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. ET.Verdict is committed to enabling legal professionals across Myanmar to access justice and legal information efficiently and securely.

1. Applicability of These Terms

1.1. Scope of Services

These Terms apply to your access to ET.Verdict's Services. Our Services include: (a) provision of digitized Myanmar legal documents (Acts, Rules, Notifications, Court Decisions) via a searchable interface; and (b) AI-powered search and summarization features.

1.2. Scope of Data Processing

  • Customer Data: Any documents or legal text you upload or input into the Services ("Customer Data"), which you control.
  • Controller Data: All other personal and usage data processed by ET.Verdict, for which we act as Data Controller.

1.3. Applicable Law

These Terms are governed by and construed in accordance with the laws of the Republic of the Union of Myanmar, without regard to its conflict of laws principles.

2. Nature of Services

2.1. Research Aid Only

The Services are intended solely as a research aid for legal professionals. ET.Verdict does not provide legal advice, and nothing within the Services shall be construed as legal counsel or a substitute for consultation with a qualified attorney.

2.2. No Warranty

We provide the Services on an "AS-IS" and "AS-AVAILABLE" basis. ET.Verdict does not warrant that: (a) the Services will be error-free; (b) all information, documents, or summaries are accurate, complete, or up-to-date; or (c) the Services will meet your specific needs.

2.3. Professional Responsibility

Lawyers using ET.Verdict remain solely responsible for the quality, accuracy, and ethical permissibility of their legal work. Your use of the Services does not relieve you of your professional obligations under the Bar Council of Myanmar's Rules of Professional Conduct.

3. User Obligations

3.1. Compliance with Laws

You agree to use the Services in compliance with all applicable Myanmar laws and regulations, including the Cybersecurity Law (2025).

3.2. Personal Liability for Unlawful Conduct

You are solely liable for any unlawful or prohibited conduct through the Services. ET.Verdict is not responsible for any violation of law by you or any other user.

3.3. Prohibited Conduct

You shall not:

  • Use VPNs, proxies, or other tools to circumvent our IP-based rate limiting or geographic restrictions.
  • Attempt to reverse-engineer, decompile, or access the underlying code, algorithms, or training data of our AI models.
  • Attempt unauthorized access, hacking, or intrusion into our systems or networks.

4. Intellectual Property Rights & AI Training

4.1. Our Intellectual Property

ET.Verdict retains all rights, title, and interest in its platform, including the AI models, search algorithms, software, and documentation.

4.2. License to Use

We grant you a limited, revocable, non-exclusive license to use the Services solely for your personal, professional legal research purposes.

4.3. AI Training on Search Queries

You irrevocably consent to ET.Verdict using your anonymized search queries, search patterns, and usage metadata to train and improve our AI models and search algorithms. This training enhances the system's ability to understand Myanmar legal terminology and user intent. ET.Verdict will not use your Customer Data (uploaded documents or personal information) for AI training without explicit written consent.

5. Limitation of Liability

5.1. "AS-IS" Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. ET.VERDICT DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

5.2. Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ET.VERDICT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO: (A) LOSS OF REVENUE; (B) LOSS OF PROFITS; (C) LOSS OF BUSINESS; (D) LOSS OF DATA; OR (E) LOSS OF REPUTATION, EVEN IF ET.VERDICT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5.3. Immunity for Certain Events

ET.Verdict shall have no liability for:

  • Interruptions of Service due to scheduled or emergency maintenance, network failures, or force majeure events.
  • Any errors, omissions, or inaccuracies in the legal documents, judicial decisions, or AI-generated summaries provided through the Services.
  • Any reliance you place on any output, summary, or analysis provided by the Services.

6. Indemnification

You agree to indemnify, defend, and hold harmless ET.Verdict, its affiliates, and their respective officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Services in violation of these Terms or applicable law.
  • Your Customer Data or any content you upload or input into the Services.
  • Any legal action or proceeding based on your use of the Services or the outputs you generate from the Services.

7. Dispute Resolution & Severability

7.1. Myanmar Jurisdiction

Any and all disputes, claims, and causes of action arising from or related to these Terms or the Services shall be resolved exclusively in the courts of the Myanmar, specifically the District Court of Naypyidaw. You hereby irrevocably consent to the exclusive jurisdiction and venue of these courts and waive any objection to such jurisdiction or venue.

7.2. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be reformed to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.
